These Platform Service Terms ("Terms") govern the relationship between Handie ("Handie," "we," "us," "our") and the entity or individual ("Customer," "you," "your") using or accessing our services ("Services"). Please read these Terms carefully along with our Privacy Policy, which outlines how we handle your data. These Terms reference and incorporate any written purchase documents executed by you and Handie ("Order Form"). Together, the Terms, Privacy Policy, and Order Form constitute the single binding agreement between you and Handie ("Agreement").
1. Eligibility and Updates
You must be at least 18 years old to use the Services. If using on behalf of a minor, you must be their parent or legal guardian. Continued use after updates signifies acceptance of the modified Terms.
2. Artificial Intelligence Disclaimer
2.1 Understanding and Responsibility
- You acknowledge that you are interacting with an AI system.
- AI may produce errors or misunderstandings.
- Handie is not liable for such inaccuracies.
2.2 User Responsibilities
- Review AI-generated content independently.
- Use your judgment before acting on AI outputs.
- You are responsible for any outcomes from AI use.
2.3 Inherent Limitations
- Outputs may be repetitive, biased, or incorrect.
- AI lacks emotion and nuanced understanding.
2.4 Disclaimer
- We make no guarantees on AI accuracy.
- Use at your own risk.
3. Access and Use
3.1 Access Rights
We grant you a limited, non-exclusive, non-transferable license to use our Services.
3.2 Account Responsibilities
You must keep your account information accurate and secure. Notify us immediately of any unauthorized access.
3.3 Prohibited Conduct
You agree not to:
- Violate laws or regulations
- Use bots, scrapers, or malicious code
- Engage in harmful, exploitative, hateful, fraudulent, or illegal activities
- Use Handie for high-risk sectors (healthcare, legal, finance, etc.) without oversight
- Generate pornographic or violent content
3.4 Usage Restrictions
Handie may apply rate limits, quotas, and moderation. You must not bypass these safeguards.
4. Orders, Payments & Refunds
4.1 Orders and Billing
You must provide accurate billing info. Orders may be canceled for fraud, system errors, or violations.
4.2 Product Info
We strive for accuracy but may update product details and pricing at any time.
4.3 Subscriptions
- Subscriptions renew automatically unless canceled.
- Refunds are not provided for partial billing periods.
4.4 Refund Policy
Requests are reviewed manually. Certain users (e.g., in EU, UK) may have statutory rights. Abuse of our refund system may result in denial.
4.5 Promotions
Separate rules may apply to promotional offers. In case of conflict, promo rules take precedence.
5. Your Obligations
5.1 Input Data
You're responsible for your prompts and any content submitted. Do not upload private or sensitive data unnecessarily.
5.2 Restrictions
- No reverse engineering or code tampering
- No IP misuse or brand defamation
- No circumvention of limits or automated data scraping
6. User Data
6.1 Ownership
You retain ownership of prompts and outputs, but grant Handie a license to process and improve our Services.
6.2 Disclaimer
We do not guarantee unique or accurate results. Similar prompts may yield similar outputs across users.
6.3 License to Handie
You grant us a license to use anonymized data for analytics and service improvement.
7. Intellectual Property
7.1 License
You receive a non-transferable license to use the Handie platform under these Terms.
7.2 Ownership
All rights to Handie's software, data, and platform IP remain with us or our licensors.
7.3 Third-Party Tools
Third-party components may be used under separate terms.
7.4 Feedback
Any ideas or suggestions you submit may be used freely by Handie.
8. Termination
We may suspend or terminate your account at any time. Upon termination, access to Handie ceases immediately.
9. Disclaimers
- The platform is provided "as is" without warranties.
- We are not responsible for third-party content or interruptions.
- Use of AI features is at your own risk.
10. Indemnification
You agree to indemnify Handie and its team against any losses or legal claims arising from your use of the Service.
11. Limitation of Liability
- We are not liable for indirect, special, or consequential damages.
- Total liability is capped at the amount you paid in the last 3 months.
12. Legal and Jurisdiction
12.1 Governing Law
This agreement is governed by German law.
12.2 Disputes
Contact us before initiating legal proceedings. We encourage resolving issues informally.
12.3 International Compliance
- EU residents retain their consumer protections.
- U.S. users must comply with export regulations.
12.4 Severability and Waiver
If a part of these Terms is unenforceable, the rest remains valid. Failure to enforce a provision is not a waiver.
